These Terms of Use ("Terms") govern your use of the Eventuality mobile and web application at eventualityapp.com (the "Service"), operated by Nearfield Labs LLC, a Wyoming limited liability company ("Nearfield Labs," "we," "our," or "us"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
Summary (non-binding). Eventuality helps you discover and organize real-world events. Content in public events is visible to anyone. Content in private events is visible to the invited pool. Direct messages are private between you and the recipient. You must be at least 18 — this is an adults-only service. Don't post harmful content, don't abuse other users, don't misuse location features. We don't verify anyone's identity or the safety of any event — meet responsibly. We may suspend accounts that break these rules.
You must be at least 18 years old to use the Service. Eventuality is an adults-only, in-person social platform and is not directed to anyone under 18. You must also meet the local age of contractual capacity in your jurisdiction. By creating an account or using the Service, you represent and warrant that you are 18 or older. We delete accounts we discover belong to anyone under 18. See our Child Safety Standards.
Create an account via email/password or Google OAuth. Provide accurate information and keep it current. You are responsible for safeguarding your credentials and for activity under your account; notify us at eventualityapp2026@gmail.com if you suspect unauthorized access. One personal account per person — creating multiple accounts to evade enforcement, inflate attendance, impersonate others, or otherwise manipulate the Service is prohibited and grounds for termination.
"User Content" means anything you post or transmit through the Service, including event listings, photos, messages, comments, profiles, and ratings. You retain ownership. You grant Nearfield Labs a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, format, display, and distribute User Content solely to operate and improve the Service. The license ends when you delete the content or your account, except (a) where recipients retain copies they have personal use of, or (b) where we must retain it to comply with legal obligations.
You represent that you own or have rights to all User Content you post, that it does not infringe others' rights, and that it complies with these Terms and applicable law.
The Service has three distinct visibility tiers. Post accordingly:

Eventuality is an adults-only (18+) service. We have zero tolerance for child sexual abuse and exploitation (CSAE) and for child sexual abuse material (CSAM). Any content or conduct that sexualizes, endangers, solicits, or exploits a minor is strictly prohibited and will result in immediate removal, account termination, preservation of relevant data, and reporting of apparent CSAM to the U.S. National Center for Missing & Exploited Children (NCMEC) and/or other competent authorities as required by law (including 18 U.S.C. §2258A). To report a child-safety concern, use the in-app report tools or email eventualityapp2026@gmail.com. Our full commitments are published in our Child Safety Standards.
The Service offers optional 1:1 voice (audio) calls between users. When you start or accept a call we request access to your microphone; you may decline, and you may revoke the permission at any time in your device or browser settings. Calls connect peer-to-peer and are not recorded or stored by us — see Privacy Policy §9. You agree not to use voice calls to harass, threaten, defraud, record another person without their consent, or otherwise violate these Terms or applicable law; the Acceptable-Use rules above and our enforcement measures apply equally to conduct during calls. There is no video calling.
Safety notice. We do not verify the identity of users, the accuracy of event listings, the safety of any venue, or the conduct of any attendee or organizer. You attend events and interact with other users at your own risk. Meet in public when possible, tell someone you trust where you are going, and never share personal or financial details with people you don't know.
If you create an event, you are responsible for the accuracy of the listing, for securing any necessary permits or permissions, for complying with local laws (health, safety, noise, alcohol), and for the conduct of attendees at your event. If you RSVP or attend, you are responsible for your own safety and conduct. Nearfield Labs is not an organizer, agent, promoter, insurer, or venue operator for any event on the Service.
The Service uses your device's location to show nearby events and to determine proximity for check-ins. Permission is optional. Precise coordinates are evaluated locally and are never transmitted or stored; all location on our servers is obfuscated to 1.5 km. See the Privacy Policy for details. You may not spoof or fake your location to check in to events you aren't attending or to claim attendance or rewards you haven't earned.
You may rate events you have attended. Ratings must reflect your genuine experience. Fake ratings, coordinated campaigns, and retaliatory ratings unrelated to the event are prohibited. We may remove non-genuine ratings and suspend accounts that manipulate them.
The Service (excluding User Content) is owned by Nearfield Labs LLC or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes under these Terms. "Eventuality" and the Eventuality logo are trademarks of Nearfield Labs LLC. The Service incorporates open-source components and third-party services (Supabase, Vercel, Mapbox, Google OAuth), each governed by its own license.
If you believe content on the Service infringes your copyright, send a DMCA notice to eventualityapp2026@gmail.com including: a signature of the rights holder or authorized agent; identification of the work and the infringing material; your contact information; a good-faith belief statement; and a statement under penalty of perjury that you are authorized to act. We will respond in accordance with the DMCA and may terminate repeat infringers.
We may review content, monitor listings, and investigate reports. We may remove content, suspend accounts, or terminate access at our discretion when we believe these Terms or applicable law have been violated. Where feasible we will notify affected users and provide a means to appeal, except where doing so would be illegal, impractical, or against user safety. You may delete your account at any time from the Service's settings; we will delete or anonymize your personal data in line with the Privacy Policy (typically within 60 days). We may suspend or terminate accounts for material breach, harmful conduct, or legal reasons — without prior notice where the cause requires. Provisions that should survive termination (Sections 3, 9, 12, 13, 14, and 17) remain in effect.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE, THAT EVENT INFORMATION IS ACCURATE, THAT ANY USER IS WHO THEY SAY THEY ARE, OR THAT ANY EVENT WILL TAKE PLACE AS DESCRIBED. YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE SERVICE AND INTERACTIONS WITH OTHER USERS.
Some jurisdictions do not permit the exclusion of certain warranties; in those jurisdictions, the disclaimers apply only to the maximum extent allowed by law, and your statutory consumer rights (including under the UK Consumer Rights Act 2015, the Australian Consumer Law, and similar regimes) are unaffected.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEARFIELD LABS AND ITS PERSONNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. THE SERVICE IS CURRENTLY PROVIDED FREE OF CHARGE; OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED US$100.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law. If you are a consumer in a jurisdiction that limits these provisions (EEA, UK, Australia, certain US states), they apply only to the maximum extent permitted.
You will defend, indemnify, and hold harmless Nearfield Labs and its personnel from claims arising out of (a) your use of the Service, (b) your User Content, (c) your breach of these Terms, (d) your violation of any law or third-party right, or (e) your conduct at any event. This does not apply to claims arising from our gross negligence or willful misconduct.
We may modify, suspend, or discontinue the Service or any feature at any time; we will use reasonable efforts to notify you of material adverse changes. We may update these Terms from time to time. For material changes we will notify you through the Service or by other appropriate means at least 30 days before they take effect. If you do not agree, stop using the Service and delete your account before the change takes effect. Continued use after the notice period constitutes acceptance.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles, except that mandatory consumer-protection laws of your country of residence continue to apply.
Before filing a claim, contact us at eventualityapp2026@gmail.com. We will work in good faith for at least 30 days to resolve the dispute informally. If unresolved, disputes will be submitted to binding individual arbitration in Wyoming conducted in English; class arbitrations and class actions are not permitted. You may opt out of arbitration by emailing eventualityapp2026@gmail.com within 30 days of first accepting these Terms or any material update to this section. Either party may seek injunctive relief in court to protect intellectual property or confidential information.
If you are a consumer in a jurisdiction that prohibits mandatory arbitration or class-action waivers (including the EEA, UK, Australia, and others), those parts of this section do not apply to you, and you may bring claims in your local courts under local law. Nothing prevents you from using an applicable official dispute-resolution mechanism, including the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Regardless of where you live, mandatory local consumer-protection rights continue to apply and take precedence over any conflicting term below.
